π Proposed Amendment to Article 7, Section 7.04 β Amendment Procedure
The Spring Creek Grove HOA Board proposes an amendment to update the process for creating, revising, or repealing bylaws.
Key Change:
Replace the current requirement of approval by 75% of Lot Owners with a simple majority of all Lot Owners.
π Current Language (Section 7.04)
The covenants, conditions, and restrictions of this Declaration shall be effective for a term of twenty (20) years from the date this Declaration is recorded, after which period the covenants, conditions, and restrictions shall be automatically extended for successive periods of ten (10) years subject to termination by an instrument signed by Owners of more than fifty percent (50%) of the Lots in the Subdivision.Β The covenants, conditions, and restrictions of this Declaration may be amended by an instrument signed by Owners of seventy-five percent (75%) of the Lots. Neither any amendment nor any termination shall be effective until recorded in the Official Public Records of Ellis County, Texas, and all requisite governmental approvals, if any, have been obtained.

π οΈ Clearing Up Confusion from the HOA Meeting
There was some initial confusion regarding the references to 50% and simple majority in this amendment. To clarify: the 50% threshold is part of the current language and only applies to stopping the automatic renewal of our Covenants, Conditions, and Restrictions (CC&Rs) after each 10-year extension. The proposed amendment focuses solely on changing the requirement for amending the CC&Rs from 75% approval to a simple majority of all Lot Owners.
